Terms of Service
Last updated: 28 October 2026
These terms are the agreement between Gofood.uk Online Ltd, trading as Gofood, a company registered in England and Wales (company number 12702164), whose registered office is at 240 Southwell Road East, Rainworth, Mansfield, England, NG21 0EQ ("Gofood", "we", "us") and the restaurant or food business that opens a Gofood account ("you"). They cover the Gofood dashboard at app.gofood.uk, ordering websites, the ordering widget, apps and any other Gofood service (together, "the Service"). By creating an account you confirm that you have authority to accept these terms for your business.
The Service is for businesses only. Consumer protection law that applies to individuals buying for themselves does not apply to this agreement.
1. The Service
Gofood lets you take orders online through your own ordering website and widget, manage your menu, accept or reject orders, and see reports. Some features (for example a custom domain and premium website, a branded app, SMS credits or an AI phone line) are add-ons that may carry a separate charge.
We may improve, change or withdraw features. If a change materially reduces what you pay for, we will tell you in advance and you may end the agreement without penalty.
2. Your account
- Give us accurate business details and keep them up to date, including your registered business name, address, VAT number (if you are VAT registered) and contact details.
- Keep logins private and use two-step verification where we ask for it. You are responsible for what happens under your account and your staff's logins.
- Tell us straight away at support@gofood.uk if you think your account has been used without permission.
3. Your responsibilities as a food business
You are the seller of the food. Your contract for each order is with your customer, not with Gofood. In particular you are responsible for:
- registering as a food business with your local authority and meeting food safety and hygiene law;
- the accuracy of your menu, prices, descriptions, photos and allergen information, including the 14 allergens and any Natasha's Law labelling that applies to you;
- the age checks needed when selling alcohol or other age-restricted products, and holding any licence they need;
- preparing, delivering or handing over orders, and dealing with customer complaints, refunds and disputes;
- your own terms of ordering and privacy policy for your customers (we provide a starting draft that you should check);
- VAT and other taxes on your sales, and setting the right tax rates in your dashboard;
- getting your customers' consent before sending them marketing, and honouring unsubscribe requests.
4. Payments from your customers
Card payments are taken through Stripe on your own Stripe account, which you connect through Gofood. You accept Stripe's own terms when you connect. Customers pay you directly: Gofood never holds your money. Stripe's processing fees, refunds, chargebacks and disputes are between you and Stripe.
Gofood's fees on online card payments are taken automatically by Stripe as an application fee at the time of each payment. We never see or store full card numbers.
Cash orders are recorded in Gofood but no money passes through us.
5. Our fees
You pay the fees shown in your plan or agreed with us in writing, which may include a monthly subscription, a fee per online order, a percentage and fixed fee on online card payments, and charges for add-ons and SMS credits. Your current fees are shown in your dashboard.
- Fees on card payments are taken from each payment as described above.
- Fees that cannot be taken from a payment (for example subscriptions, add-ons and per-order fees on cash orders) are billed monthly to the payment method you give us.
- Fees are shown without VAT unless we say otherwise; VAT is added where it applies.
- We may change our fees with at least 30 days' notice by email. If you do not agree, you can close your account before the change takes effect.
- If an invoice stays unpaid for 14 days after a reminder, we may suspend paid features until it is paid.
6. Fair use
You must not use the Service to:
- sell anything illegal, or food that is unsafe or wrongly described;
- send spam or marketing to people who have not agreed to receive it;
- upload content you do not have the right to use, or that is offensive, misleading or infringes someone else's rights;
- try to get around security, access other restaurants' data, overload the Service or copy it to build a competing product.
7. Your content and data
You keep ownership of your menu, photos, logo, wording and customer data. You give us permission to host, copy, display and adapt that content as needed to run the Service and to show your ordering website.
We handle your customers' personal data on your behalf under our Data Processing Agreement, which forms part of these terms. You can export your orders and customer lists at any time.
Gofood owns the Service, its software and design. We may use anonymous, combined statistics (which do not identify you or your customers) to improve the Service.
8. Availability and support
We aim to keep the Service running at all times but cannot promise it will never be interrupted, for example during maintenance or because of problems with the internet, hosting or payment providers. We will try to give notice of planned maintenance and fix faults promptly.
Support is available by email at support@gofood.uk.
9. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law.
Otherwise, Gofood is not liable for loss of profit, revenue, business or goodwill, or for indirect losses, and our total liability in any 12 months is limited to the fees you paid us in those 12 months.
Gofood is not responsible for the food you sell, its safety or allergen content, your dealings with your customers, or the services of Stripe and other providers you choose to use.
You agree to cover our reasonable losses if a claim is brought against us because of the food you sell or your breach of these terms.
10. Ending the agreement
You can close your account at any time by contacting us. Monthly charges are not refunded for part months.
We may suspend or close your account straight away if you seriously break these terms, act unlawfully or put customers at risk, or with 30 days' notice for any other reason.
After closing, we will keep your data available to export for 30 days and then delete it, except where we must keep records by law (for example invoices).
11. General
- We may update these terms. We will email you about important changes at least 30 days before they apply.
- If part of these terms cannot be enforced, the rest still applies.
- These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
